Warranty Terms

The warranty period is ninety (90) days.

Warranty starts on whichever date comes first:

The date the product is installed or first used, or
-
Thirty (30) days after the original purchase date
In other words, if the product is not installed or used right away, the warranty will automatically begin 30 days after purchase.
This warranty applies only to the original purchaser and is non-transferable.
1. What This Warranty Covers
This Limited Warranty covers manufacturing defects in materials or workmanship that cause the product to fail structurally under normal use during the Warranty Period.
If a covered defect is confirmed within the Warranty Period, the manufacturer’s sole and exclusive obligation, at its discretion, is limited to:

Replacement with the same or a comparable product, or
-
Refund of the original purchase price of the product only
No other remedies are available under this warranty.
2. Installation and Use Requirement
This product is intended for prompt installation and use.
The product must be installed and placed into service within thirty (30) days of purchase. Storage, delayed installation, or delayed use:

Does not delay the start of the Warranty Period
-
Does not extend the Warranty Period
-
Does not create additional warranty coverage
Products installed or first used more than thirty (30) days after purchase are expressly excluded from any warranty extension or adjustment.
3. Expected Product Characteristics in Underwater Use
Decorative products designed for continuous underwater pool environments are exposed to chlorine, bromine, saltwater systems, oxidizers, UV exposure, and ongoing water chemistry fluctuations.
Due to these conditions, changes in appearance are normal, unavoidable, and expected, including but not limited to:

Gradual or uneven fading

Loss of color vibrancy
-
Discoloration or surface dulling
-
Wrinkles in protective surface coating
These changes occur in all underwater decorative pool products, regardless of material type, and do not indicate a manufacturing defect.
4. What This Warranty Does Not Cover
This warranty expressly excludes, whether occurring during or after the Warranty Period:

Cosmetic or aesthetic changes that do not prevent the product from remaining intact

Normal wear, aging, or environmental exposure

Damage caused by:

Improper installation, handling, storage, or maintenance
-
Improper or unbalanced water chemistry
-
Chemical misuse or overexposure
-
Environmental conditions, including temperature extremes
-
Cleaning tools, methods, or chemicals not approved by the manufacturer
-
Labor, removal, reinstallation, freight, downtime, or incidental or consequential costs
Fading and delamination are inherent characteristics of decorative products used underwater and are not warrantable conditions.
5. Warranty Claim Requirements
All warranty claims must be submitted in writing within the Warranty Period and must include:

Proof of original purchase

Installation or first-use date
-
Clear photographs of the product
-
Water chemistry records upon request
Failure to provide complete documentation will result in automatic denial of the claim.
6. Warranty Time Limitation
Claims submitted after the Warranty Period has expired will be denied without exception, regardless of:

When the issue was discovered
-
Whether the product remained unused for a period of time
-
The extent of fading, discoloration, or surface change
Continued use of the product constitutes full acceptance of the product’s condition, appearance, and performance.
7. Disclaimer of Additional Warranties
This Limited Warranty is the sole and exclusive warranty provided.
All other warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.
8. Limitation of Liability
The manufacturer shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, pool downtime, labor costs, or aesthetic dissatisfaction.
9. Governing Law
This warranty shall be governed by and construed in accordance with New Jersey state laws without regard to conflict-of-law principles.
